1. Website Use – Terms and Conditions
These terms and conditions apply to your use of www.prowaterplus.co.uk (the “Website”) and any service or product you purchase from Prowater Plus Ltd. Regardless of how you access the Website, including but not limited to technologies or devices by which Prowater Plus Ltd makes the Website available to you at home or on the move these terms and conditions shall apply. You must carefully read these terms and conditions; we recommend that you print and keep a copy for reference.
The Website may only be used for lawful purposes and you may not use it in any way that infringes the rights of anyone else or that restricts or inhibits anyone else’s use or enjoyment of the Website.
You must not use any of the contents of the Website for commercial purposes. Also without prior written consent, you must not copy, crawl, frame, reproduce, republish, print, download, distribute, post/re-post, record, broadcast, edit, transmit, communicate to the public, link to or deep-link into or distribute in any way the webpages or materials on the Website, nor any computer codes, elements comprising the Website other than that solely for your own personal or internal business review and use.
Unless otherwise stated on the Website, the materials on the Website are displayed solely for the purpose of the services and products available from Prowater Plus Ltd to the United Kingdom only at this time. We are sorry but no orders can be accepted at this time from outside of the United Kingdom.
Ownership of all rights, including copyright and any other intellectual property rights, in and to the Website are owned by or licenced to Prowater Plus Ltd. Your use of the Website and any of its contents grants you no rights in relation to our intellectual property rights, or that of any third parties on the Website or its contents.
It is deemed that any material you upload to our Website will be considered non-proprietary and non-confidential, and we have the right to use, distribute, copy and disclose to third parties any such material for any purpose in the submissions received. It will be our right also to disclose your identity to any third party who is claiming that any material uploaded or posted by you to our Website or any other related Prowater Plus Ltd third party social networking Website constitutes as a violation of their intellectual property rights, or of their right to privacy.
Prowater Plus Ltd or any of its personnel will not be liable to any third party or responsible, for the content or accuracy of any materials posted by you or by any other user of our Website or third party social networking Website. We also have the right to delete or remove any submissions you make on our Website if, in our opinion or the opinion of any of our advisers, any such submission does not comply with our content standards as detailed below.
To post a submission you must be at least 18 years of age and registered. You are not eligible to post a submission if you are a supplier or manufacturer to Prowater Plus Ltd or a third party to its supply chain.
You must only write in English and are always to be polite. It may be that you require an immediate response or have a comment you wish to discuss about our service or products, if this is the case we advise you contact us directly so we can deal with your response quicker.

i. Write about Prowater Plus Ltd manufacturers or suppliers.

k. Make unsupported claims about our services and products.
l. Write comments or refer to any other service or product other than that of the service or product to which your submission relates to.
It will be the absolute discretion of Prowater Plus Ltd to reserve the right not to post or publish any submission to its Website or any of its third party websites. Prowater Plus Ltd have the right to remove it, or take any appropriate action as deemed necessary to remove any such reviews which do not comply with the rules of making a submission as set out above.

All reasonable efforts are taken by Prowater Plus Ltd to ensure that this Website is free from viruses and other malicious or harmful content. And although measures are in place to prevent such issues we are unable to guarantee that your use of this Website (including any of its content or any Website you can access from it) will not potentially cause damage to any device you use to access it.
It is the user’s responsibility to ensure they have the right equipment (including antivirus software) to use the Website safely and to prevent anything that may harm or damage the device from which they access the Website. With the exception when required only by applicable UK law, Prowater Plus Ltd will not be liable to any person for any loss or damage they suffer as a result of viruses or any other malicious or harmful content that they access from or via the Website.
We do not link to any other companies websites, therefore if you click a link in our Website which takes you to another companies Website you should immediately close the third parties website in case it contains harmful content. Any third party websites which you access through www.prowaterplus.co.uk or any social networking third party websites linked to Prowater Plus Ltd which link you to another third party website are not vetted by Prowater Plus Ltd, and we do not have any control over their contents. Except where required by applicable UK law, Prowater Plus Ltd will not accept any liability in respect of the use of these third party websites.
2. Website Supply Only – Terms and Conditions
The Website Supply Only Terms and Conditions of Sale apply to any order you place and transaction you make directly through www.prowaterplus.co.uk for products sold on a supply only basis.
With regards to orders placed through the Website, the following Website Supply Only Terms and Conditions of Sale shall apply no matter how you access the Website including any technology or device on which allows you to access www.prowaterplus.co.uk. You are obliged to read these Website Supply Only Terms and Conditions of Sale in full.
By placing an order through the Website, you are confirming that you have read, understood and agree to these Website Supply Only Terms and Conditions of Sale in their entirety. If you do not agree to these Website Supply Only Terms and Conditions of Sale in their entirety, you must not order any product or service through the Website.
2.1 Placing an Order
You have the option to open an account with Prowater Plus Ltd which will require you to provide some compulsory personal information. If you prefer not to open an account, you can choose to place your order via our guest checkout.
You confirm all information and details provided by you to us (including at registration) are true and accurate. It is always the user’s responsibility to keep all records up to date in all respects all the time. You can update or correct your details at any time by visiting www.prowaterplus.co.uk and going to My Account.
When creating an account, we may provide you with and/or ask you to create/use passwords or other means to allow access to certain areas of the Website and also to maintain the security of your account. You are responsible for maintaining the confidentiality of your account information and any such passwords. Prowater Plus Ltd accepts no liability to any person for any damages or loss that may occur as a result of any failure by you to protect your account and passwords. If you become aware or suspect any unauthorised use of your password or account, immediately contact us.
If Prowater Plus Ltd is suspicious that fraudulent activity may be coming from your account, it reserves the right to refuse you access to your account and if necessary, delete the account altogether.
If you do not wish to create an account, you are able still able to proceed with your order via our guest checkout. It is important to note that you will still need to provide certain compulsory personal information for us to process your order. When you use the guest checkout, we do not store the details that you provide (save for processing your order, or if you have opted in to receive marketing communications from us). Once your order has been submitted you will be given the option to register for an account.
2.2 Order Acceptance
Please be aware that completion of our online checkout procedure does not constitute our acceptance of your offer to purchase products from Prowater Plus on a supply only basis. We aim to notify you by email as soon as possible to acknowledge that we have received your order and are processing it. Acceptance of your order will only take place when the payment is received, and we dispatch the product(s). In the lead up to the dispatch of any product(s) Prowater Plus Ltd reserves the right to decline an order for any reason, including any regulatory or legal reasons.
The contract duration will commence from when you receive the order dispatch email and last until the last day of your right to return the product(s).
In the event that we are unable to supply the product(s) you ordered; your order will not be processed. You will be informed in writing (normally by email) and, if payment has already been taken for the product(s) we will aim to refund you as soon as reasonably possible.
If fulfilling an order or any aspect of the order is deemed to be unlawful or illegal, Prowater Plus Ltd has the right to cease to fulfil and stop the order at any time. The order can be stopped by Prowater Plus Ltd even if you have been sent confirmation the order has been received or after product(s) have been dispatched. In such an event you acknowledge Prowater Plus Ltd shall not incur liability in these circumstances.
2.3 Payment Transactions
You will be asked to enter your payment details during the checkout process. When you are using either a debit or credit card, by the completion of your payment detail on our Website you confirm that the debit or credit card being used for the payment transaction is yours. Any fields indicated as compulsory must be completed to proceed with the purchase of the product(s).
All products ordered remain the property of Prowater Plus Ltd until they have been delivered to the address specified by you. If payment has not been received but you have received the product(s) order from Prowater Plus Ltd, you must pay for in full or return the products in accordance with our returns policy. In the event of returning any product(s) they must be returned in the same condition you received them, and at your own expense.
Within 30 days of the date upon which we cancel your order, Prowater Plus Ltd has the right to arrange collection of the products at your expense. We reserve the right to charge you for all and any damage to the products including any costs that may arise through interference with your unpaid order.
Prowater Plus Ltd will deliver to the UK address specified on your order. If no one is available at the residential address or other address at the time of delivery, a note will be left advising whether your order has been returned to the depot or left in a safe place e.g. with a neighbour.
Free delivery applies to all orders unless otherwise stated and all orders sent require a signature by our chosen courier.
All risk in the products you order shall pass to you when they are delivered to the delivery address specified in your order this includes but is not limited to damage to the products and/or risk of loss. Any dates quoted for delivery of the products are approximate only and Prowater Plus Ltd shall not be held liable for any delay or failure to deliver the products if the delay caused or failure is wholly or partially caused by any circumstances beyond our control.
2.5 Order Amendments
If you need to make any changes to your order you must notify us in writing within a reasonable time scale. In the event you amend or change your order you may find this affects your delivery time and also the price you pay for the products (the selling price on the day you make your order amendment will apply).
2.6 Order Cancellation, Returns and Refunds
Any customer contracting with Prowater Plus Ltd either online or by phone have the right to cancel all or part of their order up to 14 days after the day the products are received. To exercise this right, you must inform us of their decision to cancel in writing within the timescale stated above.
All reasonable care of the products must be taken while they remain in the possession of the customer. The customer is responsible for returning any products no later than 14 days from the day that they have communicated with Prowater Plus Ltd to notify us of their cancellation from the contract to us. The customer shall send back any products at their own cost, the return deadline will be deemed to be met if the products send back before the period of 14 days expires. All products must be returned in their original packaging.
Any products being returned are to be sent to the address advised by Prowater Plus Ltd as notified in their correspondents. Prowater Plus Ltd will aim to process your refund process your refund within 3-5 business days.
When returning products to us, it will not be our responsibility for any damage or loss that may occur during transit, and for this reason Prowater Plus Ltd recommends you use a recorded delivery service. In the unlikely event returned products are damaged or lost in transit we reserve the right to charge you or not refund any amounts determinable to such damage or loss.
This is not a full statement all your rights and does not affect your statutory rights of which a copy can be sort from your local Citizens’ Advice Bureau.
2.7 Descriptions of Products and Services
Prowater Plus Ltd have taken all reasonable precautions to ensure that prices quoted on our Website are correct and that all products and services have been described fairly. Considering this please note the following when ordering any products or services through the Website.
• Prices are displayed in pounds Sterling including UK VAT where applicable unless we expressly indicated otherwise.
• Any dimensions, weights and capacities shown are approximate only.
• We try to display the colours of our products accurately on the Website. However, the colours you see will depend on your monitor and for that reason we cannot guarantee that your monitor’s resolution and display of any colour will reflect accurately the colour of the product(s) on delivery.
• Packaging shown for any products may vary from that shown.
• We will only accept orders if there are no material errors in the description of the products or services, or their prices stated on the Website.
• All products are subject to availability. We aim to inform you as soon as possible if the product(s) or service(s) you have ordered are unavailable at that time and inform you of when they are likely to be back in stock and/or your order fulfilled.
2.8 Limitations of Liability
Prowater Plus Ltd will use all reasonable endeavours to carry out its obligations within a reasonable period of time but will not be liable to the Customer, for any loss, costs or expenses arising directly or indirectly from any delays in doing so and Prowater Plus will not be deemed to be in breach of its agreement with the customer by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the agreement, if the delay or failure was due to any cause beyond Prowater Plus Ltd reasonable control.
Except in respect of death or personal injury caused by Prowater Plus Ltd negligence, Prowater Plus Ltd will not be liable to the customer for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims, which arise out of or in connection with the supply of the Products other than as a result of a breach of an obligation arising under the Sale of Goods Act 1979 (as amended) and the Supply of Goods and Services Act 1973.
Prowater Plus Ltd shall supply to you products of a satisfactory quality. If we deliver a products to you that are not satisfactory quality, you can contact us for a replacement or repair, if these remedies are not possible, for a refund.
It is your responsibility to follow any advice we given to keep products we supply safe this includes familiarising yourself with any instructions or product manuals provided with the products. Prowater Plus Ltd cannot accept liability for damage to products we have supplied when such damage is caused by your failure to follow this advice.
2.9 General Terms
If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other terms and conditions and the remainder of the provision in question will not be affected and remain in full force and effect.
Prowater Plus Ltd will not accept liability for any damages or losses which are not reasonably foreseeable arising out of or in connection with the Website Supply Only Terms and Conditions or use of the Website.
English law will apply to the agreement between Prowater Plus Ltd and the customer and any matter that arises out of your use of the Website. The parties agree any disputes will be subject to non-exclusive jurisdiction of the English courts and all contracts shall be concluded in English.
You may find other legal notices in other areas of our Website which relate to your use of the Website. All of these will, together with these terms and conditions regulate your use of our Website.
Prowater Plus Ltd reserves the right to update any of its terms and conditions from time to time to meet its changing business needs or comply with UK law. Any updates made will be posted on this Website.
No delay or relaxation by Prowater Plus Ltd in applying any remedy or right under these terms and conditions shall serve as waiver of that remedy or right nor shall affect Prowater Plus Ltd ability to later exercise that remedy or right. Any waiver must be agreed by Prowater Plus Ltd in writing.
The Website Supply Only Terms and Conditions set out the entire agreement between Prowater Plus Ltd and the customer and supersede all prior terms, warranties, conditions and/or representations to the fullest extent permitted by law.
3. Supply and Install – Terms and Conditions
The Supply and Install Terms and Conditions of Sale apply to any order you place with Prowater Plus Ltd for those products supplied on a supply and install basis.
By placing an order with Prowater Plus Ltd, you are confirming that you have read, understood and agree to these Supply and Install Terms and Conditions of Sale in their entirety. If you do not agree to these Supply and Install Terms and Conditions of Sale in their entirety, you must not order any product or service from Prowater Plus Ltd.
In the supply and install terms and conditions English law will apply to the agreement between Prowater Plus Ltd and the customer. The parties agree any disputes will be subject to non-exclusive jurisdiction of the English courts and all contracts shall be concluded in English.
3.1 All the terms of the contract between Prowater Plus Ltd and the customer are contained in this contract and no variation of these terms nor shall cancellation of this contract be considered unless a written request is received within 14 days of the date of this contract.
3.2 Prowater Plus Ltd will display prices in pounds Sterling including UK VAT where applicable unless we expressly indicated otherwise. If government instituted changes occur, it is the rate prevailing at the date of the invoice that will be charged.
3.3 Quotes issued by Prowater Plus Ltd are valid for 28 days, and work must start within 90 days of acceptance after this time it may be necessary for the works to be re-quoted.
3.4 The price quoted by Prowater Plus Ltd does not include the cost of removing any dangerous waste material, such as asbestos, which Prowater Plus Ltd could not reasonably identify when Prowater Plus Ltd gave the customer the quote. The event of this issue arising in relation to the works carried out by Prowater Plus Ltd is extremely rare, however where asbestos has been removed, the customer will need to provide a site clearance for reoccupation certificate before Prowater Plus Ltd can carry out any further work at the Property.
3.5 Prowater Plus Ltd shall not be responsible for the removal of all non-hazardous waste materials created by the installation. Unless otherwise stated.
3.6 Any dates of commencement and completion of works are offered in good faith and are based on the position of the date of order. They are not guaranteed and could be subject to delays because of strikes, accidents, government direction, force majeure, mechanical breakdowns, unavailability of materials and parts and other causes beyond Prowater Plus Ltd control.
Prowater Plus Ltd will make all reasonable endeavours to start and complete the work within the given time scale but will not accept any liability for unforeseen delays whatsoever. The time it takes Prowater Plus Ltd to complete the work will have no effect on the quoted price.
3.7 The customer may be required to prepare the area prior to installation such as clearing the area near their stopcock. If the stopcock is enclosed in a housing the housing may need to be removed to enable Prowater Plus Ltd to install the ProCompact+ in this event customer are to bring to the attention if such works may be required. Depending on the information provided Prowater Plus Ltd may deem a site visit is required to inspect the area and provide a more accurate quote to complete the works. If Prowater Plus Ltd does carry out any additional work such as creating/building a new boxing to the stopcock area to house the ProCompact+.
3.8 Prowater Plus Ltd will make good any damage caused during the installation to the immediate area but does not undertake to replace any specialised finished or damage outside of the area of work. Prowater Plus Ltd accepts no responsibility for any damage resulting from other defects in the product at which the installation is carried out. Any complaint or claim by the customer for compensation for any damaged or alleged damaged caused by Prowater Plus Ltd, for which the customer may or may not be entitled to under these supply and install terms and conditions, must be made in writing to reach the Prowater Plus Ltd within 7 working days of completion of the installation. Time is of the essence and if such complaint or claim is not received within the period of 7 days, Prowater Plus Ltd will accept no liability whatsoever.
3.9 When making good, any work resulting from installation, Prowater Plus Ltd will endeavour to match existing materials where possible but reserves the right to substitute other materials.
3.10 If the customer finds any issues with the work that has been carried out by Prowater Plus Ltd, the customer must notify Prowater Plus Ltd and allow Prowater Plus Ltd time to rectify the issues. If the customer opts to have someone else carry out the remedial work, then the customer will still be liable to the full amount owed.
3.11 If the customer is a tenant, the customer will need the landlord’s permission before the customer can authorise Prowater Plus Ltd to start the work, and Prowater Plus Ltd may require evidence from the customer that such permission has been obtained. If Prowater Plus Ltd carries out unauthorised works at the landlord’s property, where the customer has failed to obtain permission or where the customer has given Prowater Plus Ltd false or inaccurate information, the customer will compensate Prowater Plus Ltd for any losses suffered as a result of the customers failure to obtain the customer’s landlord’s permission.
3.12 The customer shall be responsible for ensuring that the supply and fitting of the products complies with every applicable statue order in Council, regulation or direction of Government, local or other authority and in particular that the customer has lawfully obtained very necessary licence permit or authority required in connection therewith.
3.13 If the customers property is a listed building, it is the customer’s responsibility to ensure that necessary consent is obtained before Prowater Plus Ltd starts the work, and Prowater Plus Ltd will require evidence from the customer that such consent has been obtained. Failure to obtain necessary consent may result in the customer being prosecuted in the criminal courts. Prowater Plus Ltd will not be able to start any work where appropriate planning consent has not been obtained, or where the customer is not able to provide the Prowater Plus Ltd with the sufficient evidence of such consent. If Prowater Plus Ltd carry out unauthorised works at the customer’s property, where the customer has given Prowater Plus Ltd false or inaccurate information, the customer will compensate Prowater Plus Ltd for any losses the Prowater Plus Ltd suffers as a result of the customer’s failure to obtain the necessary planning permission, which may include court fines and/or penalties.
3.14 Prowater Plus Ltd engineer will advise the customer, whilst the quoted works are being carried out, about any other works that are needed to avoid future problems. Prowater Plus Ltd may suggest corrections to any design faults that may cause a problem in the future following the installation of the ProCompact+ giving the customer the opportunity to have any additional works completed which directly link to the ProCompact+ to avoid potential issues in the future.
3.15 To carry out the works as quickly as possible Prowater Plus Ltd my use a Prowater Plus Ltd approved installer. All installers that Prowater Plus Ltd use are fully qualified. Prowater Plus Ltd are responsible for the approved installers used.
3.16 The customer will give access to the premises and to any member of Prowater Plus Ltd and its workmen at reasonable times so that Prowater Plus Ltd may complete the installation in accordance with this contract.
3.17 Payment terms on supply and installation will be 50% deposit to be paid on the day of the booking/sale, and a second payment of 50% to be paid on completion of the installation (unless agreed otherwise by Prowater Plus Ltd).
Payment methods accepted are BACS transfers, credit or debit cards full details are stated on our quotes/invoices.
3.18 This contract is binding on both parties and is subject to cancellation only in the following circumstances.
a. If the customer informs Prowater Plus Ltd that the customer wishes to cancel this agreement within 14 days of their acceptance. The customer’s notice of cancellation will be taken to be received by Prowater Plus Ltd on the date that the customer information Prowater Plus Ltd in writing. Please note that the customer may be required to pay for any works which had been completed with the customers permission and/or customer any costs that Prowater Plus Ltd has incurred liability for and cannot recover, prior to the customer notifying Prowater Plus Ltd that the customer wishes for this agreement to be cancelled.
b. If Prowater Plus Ltd wishes to cancel this agreement, Prowater Plus Ltd can do so at any time, by providing the customer with written notice. If Prowater Plus Ltd cancels this agreement without good reason, Prowater Plus Ltd will pay the customer any reasonable costs or losses the customer incurs as a direct result of Prowater Plus Ltd cancellation.
3.19 Prowater Plus Ltd reserves the right to charge a monthly interest rate on any balance remaining outstanding after the end of the payment term specified on the invoice received after completion of the installation. The interest rate charged will be 8% plus the base rate as set by the Bank of England.
3.20 Prowater Plus Ltd offers a one year guarantee on labour costs when the fault with the installation is due to Prowater Plus Ltd negligence.
3.21 Using personal information
Prowater Plus Ltd may use the customers information to do the following:
a. Provide the customer with the services the customer has requested, which may include loyalty and incentive schedules that the Prowater Plus Ltd may run from time to time.
b. Help run and contact the customer about improving the way Prowater Plus Ltd runs, any accounts, services and products Prowater Plus Ltd have provided before, now and in the future.
c. Help prevent and detect debt, fraud or loss.
d. Help train Prowater Plus Ltd staff.
e. Contact the customer in any way (including post, email, phone, text, multimedia messages, other forms of electronic communications, or by visiting the customer). About products and services that Prowater Plus Ltd or their selected partners are offering. When Prowater Plus Ltd contacts the customer, Prowater Plus Ltd may use information they hold about the customer to do so. If Prowater Plus Ltd is contacting the customer to tell the customer about any offers, then Prowater Plus Ltd will, as far as possible, do this in line with how the customer has told Prowater Plus Ltd that the customer would prefer to receive marketing information (the customers recorded marketing preferences). The customer can ask Prowater Plus Ltd not to send the customer any information by contact Prowater Plus Ltd.
Prowater Plus Ltd may use the customer’s information to help train their staff. Prowater Plus Ltd may also monitor and record any communications Prowater Plus Ltd have with the customer, including phone conversations and emails, to make sure that the Prowater Plus Ltd is providing a good service and to ensure that Prowater Plus Ltd are meeting their legal responsibilities.
Prowater Plus Ltd may also pass these details onto manufacturers, in order to register guarantees/warranties the customer is entitled to. These organisations may pass this information to local authorities to meet building regulations. Prowater Plus Ltd or approved third party organisations such as manufacturers may also use this information to contact the customer to inspect the items installed, recall faulty products and carry out audits, and for healthy and safety purposes.
If the customer gives false or inaccurate information and fraud is identified, Prowater Plus Ltd will pass the customer’s details on to the fraud-prevention agencies. Law-enforcement agencies (such as the Police and HM Revenues & Customs) may receive and use this information.
